1. Online Store Terms
You must be the age of majority in your jurisdiction or use the site with the involvement and permission of a parent or legal guardian. The Service is not directed to children under sixteen (16), and we do not knowingly collect their personal information.
You may not use the site or products for an unlawful or unauthorized purpose or transmit malware or destructive code.
2. General Conditions
We may refuse, limit, or cancel service or transactions for lawful reasons, including suspected fraud, security risk, abusive conduct, sanctions restrictions, inventory error, or violation of these Terms. We will not exercise this right in a manner prohibited by law.
You may not reproduce, resell, exploit, scrape, or commercially use a material part of the Service without written permission, except as allowed by law.
3. Accuracy and Timeliness of Information
General site content is provided for convenience. Product pages, measurements, colors, photographs, lens descriptions, prices, and availability may contain errors or vary because of screen settings, manufacturer updates, lighting, production tolerances, or data supplied by brands and distributors.
4. Service, Promotions, and Prices
Prices, promotions, availability, and features may change without notice. A promotion applies only during its stated period and according to its disclosed exclusions. Promotional codes cannot be combined unless expressly allowed. We may correct a pricing or promotional error and cancel an affected order, with any required refund.
5. Eyewear Products
Products may have limited quantities. Returns, exchanges, refunds, and store credits are governed by our Return & Refund Policy.
Frame measurements and fit descriptions are guidance, not a guarantee of fit. Optical frames may contain clear demonstration lenses rather than prescription lenses unless expressly stated otherwise. Product color, tint, gradient, mirror effect, and pattern may differ slightly from the on-screen image.
An item is final sale only when clearly identified as final sale before purchase. Sale or discounted merchandise is not automatically final sale.
6. Billing, Orders, Verification, and Cancellations
You agree to provide complete and accurate account, billing, payment, shipping, and contact information. We may request reasonable payment, identity, address, or fraud-prevention verification before shipment.
We may limit or cancel quantities placed through the same account, payment method, billing address, shipping address, household, reseller, dealer, or distributor. If we change or cancel an order, we may contact you using the information supplied with the order.
Cancellation requests must be submitted within one (1) hour after the order is placed. After that period, an approved cancellation may be subject to a five percent (5%) cancellation/processing fee. A shipped order cannot be cancelled. The fee does not apply where prohibited or when cancellation is required because we cannot fulfill within a promised or legally applicable shipping timeline.
7. Shipping, Delivery, and Import Charges
Processing, transit, tracking, delivery, loss, damage, and refused-shipment terms are governed by our Shipping Policy. Delivery dates are estimates unless expressly guaranteed in writing.
Unless checkout expressly states otherwise, international customers are responsible for duties, taxes, tariffs, customs, brokerage, carrier advancement, currency-conversion, and other destination or third-party charges.
8. Optional Tools, Apps, and Third-Party Links
The site may provide access to payment processors, review providers, shipping protection, social networks, analytics, or other third-party services. Their services may be governed by separate terms. To the extent permitted by law, your use of optional third-party services is at your discretion and risk.
9. Reviews, Feedback, and Other Submissions
If you submit reviews, photographs, suggestions, questions, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, publish, translate, and display that content in connection with our business, subject to applicable privacy law.
You must own or have permission to submit the content. It must not be unlawful, deceptive, defamatory, abusive, infringing, or contain malware. We may moderate or remove content but have no duty to do so.

11. Errors, Inaccuracies, and Availability
We may correct errors relating to descriptions, measurements, colors, prices, promotions, shipping charges, transit times, or availability, including after an order is submitted. If we cancel because of an error or inability to fulfill, we will issue any refund required by law.
12. Prohibited Uses
You may not use the Service to violate law; infringe rights; harass or discriminate; submit false information; distribute malware; collect others' personal information unlawfully; spam, phish, scrape, or interfere with security; impersonate another person; or facilitate fraud or unauthorized payment activity.
13. Disclaimer of Warranties
Except for express written warranties and rights that cannot be excluded, the Service and products are provided “as is” and “as available.” We do not promise that the Service will always be uninterrupted, secure, current, or error-free.
Nothing in these Terms excludes a manufacturer warranty or a consumer right or remedy that cannot lawfully be waived.
14. Limitation of Liability
To the maximum extent permitted by law, Dellamoda Inc. and its affiliates, officers, employees, agents, contractors, suppliers, service providers, and licensors will not be liable for indirect, incidental, punitive, special, or consequential damages arising from the Service or products. Where a limitation is not permitted, liability is limited only to the extent lawful.
15. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Dellamoda Inc. and its affiliates, officers, employees, agents, contractors, suppliers, and service providers from third-party claims arising from your material breach, unlawful use of the Service, or infringement of another person's rights. This does not apply to the extent a claim results from our negligence, willful misconduct, violation of law, or breach.
16. Severability and Termination
If a provision is unenforceable, it will be enforced to the fullest lawful extent and the remainder will continue. We may suspend or terminate access for material violations, unlawful or fraudulent use, or security threats, subject to applicable law.
17. Entire Agreement and Waiver
These Terms, the Full Policy, the Return & Refund Policy, Shipping Policy, Privacy Policy, and other posted operating rules constitute the agreement concerning use of the Service and purchases. A failure to enforce a provision is not a waiver.
18. Governing Law
These Terms are governed by the laws of the State of California and applicable federal law of the United States, without regard to conflict-of-law principles, except where another jurisdiction's law must apply. Nothing restricts rights or venues that cannot lawfully be restricted.
19. Changes to These Terms
We may update these Terms by posting a revised version. When required by law, we will provide reasonable notice before a material change affecting customer rights, fees, cancellation or refund obligations, or dispute procedures takes effect.
